Nigeria’s Election Disputes: Better Handling Overdue

Nigeria’s election process would be incomplete without the establishment of an electoral offences commission. This was the cogent statement made by The Chairman of the Independent National Electoral Commission (INEC) Professor Mahmood Yakubu, last week.

This is because one unending malaise in the nation’s election system from colonial times, is the ease with which elections are rigged in the country without consequences. It is a subject that is overdue for action. An election offences commission, if well-handled, can drastically reduce the high degree of electoral malpractices in the country.

Even those of us who have always cautioned against an increase in the number of public bodies in the country are persuaded that the commission can best be seen as an unavoidable structure for now, notwithstanding the position of the Economic and Financial Crimes commission EFCC that the proposed commission on election offences is perhaps one more law enforcement body too many.

Whereas it makes plenty of sense to call for the establishment of an electoral offences commission, it must be remembered that the work of the commission would also end up in the judiciary.  

Therefore, it is crucial to place high premium on how the framework for the settlement of election disputes is managed in the country. As the nullification of some election results by the judiciary has clearly shown, the announcement of election results and declaration of winners do not conclude an election process until the judiciary settles disputes arising from the process.

In other words, a candidate declared as winner of an election is only certain that he or she will hold the relevant office where there are no disputes or where whatever disputes that were disclosed are pronounced upon by the judiciary. Unfortunately, how the segment is currently managed is quite tardy with each party to a dispute taking whatever steps to outwit the opponent. Sometimes, because there is a constitutional time limit for dealing with election disputes, some candidates are able to manipulate the judiciary to introduce delays that would then overtake the dispute.

The handling of cases in the recently conducted governorship elections in Ekiti and Osun states aptly confirms the point that several hurdles are unduly placed on the way of petitioners. Since the declaration of a winner in the governorship election held in Ekiti state on June 18, 2022, the first runner-up, Engineer Segun Oni of the Social Democratic Party SDP has not been given a fair chance to follow the approved process of an election dispute. According to the SDP, INEC has been preventing the party’s legal team from having access to inspect the election materials as ordered by the election tribunal.

Considering that the settlement of election disputes is an integral part of the election process, is it really necessary for a party to first seek the assistance of a court before the umpire would make relevant materials available to her for inspection? It appears in bad taste for INEC to continue to hold-on to the materials after the relevant tribunal had ordered her “to give unhindered access to the petitioner to inspect the electoral materials which include, Bimodal Voter Accreditation System (BVAS) all ballot papers and voters registers.”

It is worse that the reason reportedly given for its action was that such materials had been moved from the state – Ekiti, to its headquarters. Why would INEC transfer materials for conducting an election in a state immediately after the declaration of a winner when the contest has been subjected to a dispute? It is more annoying that the INEC spokesperson in the state, Mrs. Rolake Odebunmi was quoted to have said that only half of the materials being requested by the SDP are in the custody of the Ekiti state office of INEC.

Again, the SDP had to formally apply to the tribunal to enable her use substituted service to serve the petition on all relevant bodies who had virtually vanished after the polls. In truth, after a winner is declared in a Nigerian election, it is customary for most of those required to defend the case to evade service so as to make a petition difficult to prosecute.

Evidence that election disputes are treated same way everywhere is established by the experience in Osun state where a governorship election was held on July 16, 2022. Governor Gboyega Oyetola who never provided a level playing field for the election until he lost it, is now at the receiving end. First, he has had to go to the tribunal to get an order for INEC to grant him access to inspect the materials used for the polls.

Second, it is now the turn of the winner of the election, Senator Ademola Adeleke to become elusive while the time allowed the tribunal is gradually running out. The report now is that security guards at his Ede residence have refused to let the bailiff serve Adeleke the notice of summons. In the interest of justice therefore, the chairman of the tribunal, Justice Tertsea Kume has appropriately directed that the notice be served through the substituted service of pasting the summons on the notice board of the tribunal

References to Ekiti and Osun states should not be taken to mean that the trend is restricted to both states, they are only the latest culprits.  In 2019, the election petition tribunal hearing cases concerning the governorship election in Nasarawa state had to order INEC to allow Musa Nagogo of the Peoples Democratic Movement PDM to inspect election materials over his original complaint that his name and party logo were omitted from the list.

At the federal level, the PDP candidate Atiku Abubakar spent precious time pleading to be allowed access to the presidential election materials for inspection. In 2015, the APC governorship candidate in Rivers state Dakuku Peterside was reported to have virtually abandoned his petition out of frustration from among other things, the refusal to grant him access to inspect election materials.

There have been other occasions where it was the judiciary itself that was used to frustrate an election petition. Here, let’s recall the classical case of the handling of the petition arising from the Adamawa state governorship election held on February 4, 2012. INEC had declared governor Murtala Nyako as winner which was upheld by the election tribunal. On appeal which the constitution says must be concluded in 60 days, the judiciary did nothing for as many as 58 days.

Some 48 hours before deadline, the then Chief Justice had to read the riot act following the protest of the opposition party. Alas, it was too late for meaningful justice to be served. Should anyone who deliberately slows down the process not be penalized for it? Well, even courts have been getting engaged in the collation of results while working to the answer only to credit the “winner” with more votes than the number of voters accredited to vote at the relevant election.

It can therefore be concluded that it is not enough to establish an electoral offences commission or an election tribunal if undemocratic practices would be used to desecrate the legal processes for ventilating grievances. As reforms are being made by INEC to improve upon the procedures and processes for voting, other bodies such as election tribunals must make copious plans to guarantee the continuation of a level playing field after voting till the end. To use technicalities to frustrate the grounds of protests put forward by some candidates can encourage the use of extra-legal means that can lead to general breakdown of law and order.

Whether it is accreditation, voting, counting of votes, declaration of winners or settlement of election disputes, Nigeria is overdue for a process that can add her to those nations whose elections are accepted as credible. The real prayer today is for all those concerned to bring an end to the unjust handling of election petitions which often sustains ample bitterness in the polity.

Nigeria’s champion sprinter, Tobi Amusan on Friday night won silver medal at the ongoing Diamond League Meet after breaking through at this year’s World Athletics Championship in Oregon, United States.

Still smarting from the record Commonwealth Games gold she won in Birmingham earlier in August, Amusan hoped to continue her superlative performance but met a resistant hurdle as she lost the gold medal to 2020 Tokyo Olympics winner, Jasmine Camacho-Quinn of Puerto Rico.

Camacho-Quinn got one over Tobi Amusan winning the women’s 100m Hurdles at the Diamond League in a new Meeting Record of 12.34s (-0.9).

Amusan finished second in 12.45s and qualified for Zurich, while US’ Tia Jones ran a new Personal Best of 12.47s to finish third.

The Diamond League is an annual series of elite track and field athletics competitions comprising 14 of the best invitational athletics meetings.

The series sits in the top tier of the World Athletics one-day meeting competitions.

Five Dead As Imo Police Raid ESN Camp

The tactical team of the Nigeria Police Force, Imo State Command has raised a camp allegedly belonging to the Eastern Security Network (ESN) and the Indigenous People of Biafra (IPOB) in Izombe, the Oguta Local Government Area.

CSP Michael Abattam, the state Police Public Relations Officer (PPRO), stated in a release on Friday that the raid on the hoodlums’ camp came after a thorough investigation of technical intelligence and reliable information on the group’s activities.

The police spokesman claimed that when the criminals saw the police officers, they started a gunfight with them but were defeated by their greater weaponry and professional positioning.

He claimed that during the intense gunfight, the thugs lost a significant number of members, forcing them to flee into the bush while still carrying varied degrees of bullet wounds.

He said, “Following their removal, the operatives moved in and carried out a comprehensive search of the camp, discovering the following items: three English-made Pump Action Guns, 118 GPMG ammunition, 41 AK-47 live ammunition, 19 G3 ammunitions, One (1) cut to size locally made double barrel, one locally made double barrel, 4 locally made pistols, 4 locally made explosive devices, military uniforms, police uniforms, Biafra flags, four ESN caps, 1 pair of police boot, various types of hard drugs, some police accoutrements, 4 live tortoises, large quantities of weeds suspected to be Indian hemp, and pieces of red cloths were recovered to the station.”

He claimed that following the successful operation, the agents were ambushed by the hoodlums who then engaged them in another gunfight as they were exiting the hoodlums’ den.

According to the PPRO, the operatives were able to overpower the thugs during the exchange of gunfire, and in the process, five of them were neutralised.

“Sadly, three (3) police officers received non-life-threatening injuries and were transported to a government hospital for treatment,” he noted.

He also stated that after their defeat, the gunmen launched a retribution attack in the villages, setting fire to the residences of active and former police personnel as well as those of other security organisations.

According to CSP, homes belonging to people they believe to be security agency informants were also destroyed by fire

Soludo Denies Discovery Of Gold Reserve In Anambra

The Anambra State Governor, Prof. Chukwuma Soludo, has denied the news of the discovery of a large deposit of gold in a part of the state.

An online medium had through a report alleged that the discovery of gold reserve estimated over 20 million tonnes and worth over $900tn in Ehamufu, Anambra State.

The report also alleged that Soludo, in his capacity as the chairman of the South East Governors’ forum, briefed journalists at the end of a meeting of the forum on the development.

But reacting to the claims, the governor in a press statement through his Press Secretary, Mr Christian Aburime, on Friday, described the report as fake and misleading.

The statement was titled ‘Purported discovery of gold reserve of over 20 million tonnes worth over $900tn in Ehamufu, Anambra State’.

The governor advised the general public to completely disregard the report and every material therein as a fake news item, saying the state government has specific channels where it churns out information to the public.

The statement read, “The attention of the government of Anambra State has been drawn to a fictitious and fallacious write-up with the above heading which has been making the rounds in some social media handles.

“Ehamufu is not in Anambra State. Governor Chukwuma Soludo is not the Chairman of the South East Governors’ forum, neither did he brief newsmen of any meeting held by the forum or phantom discovery of gold reserves in Ehamufu, Anambra State, as allegedly claimed by the writer(s).

“The entire news story including every statement or quotation allegedly attributed to Soludo are mere falsehoods without an iota of truth.

“The general public is hereby advised to discountenance and disregard these claims as a figment of the writer’s imagination. The entire news item remains a mischievously cooked-up story with the clear intention to mislead the general public.

“For emphasis, the general public is again advised to completely disregard the news story and every material therein as a fake news item.”

CBN: eNaira Records Over 4bn Naira Transactions

The Central Bank of Nigeria (CBN), digital currency, eNaira has recorded 200,000 volumes and four billion Naira value of transactions since its inauguration in 2021.

Mr Godwin Emefiele, the CBN Governor said this on Thursday in Abuja at the grand finale of the “eNaira Hackathon”.

The News Agency of Nigeria (NAN) reports that the hackathon is a CBN’s collaborative initiative with the African Fintec Foundry (AFF).

it is aimed at bringing together teams of talented entrepreneurs, developers, designers, solution developers, problem-solvers and ‘code magicians’ from Africa to develop innovative solutions for improved adoption of the eNaira.

The competition was part of efforts by the CBN to drive financial inclusion, facilitate macroeconomic growth and integrate the Nigerian economy into the world-leading economies through innovation and cutting-edge emerging technologies.

NAN also recalls that the eNaira was inaugurated on Oct. 25, 2021 by President Muhammadu Buhari, making Nigeria the first African country to launch a Central Bank Digital Currency (CBDC).

Emefiele said since its inauguration, eNaira had reached 840,000 downloads, with about 270,000 active wallets comprising more than 252,000 consumer wallets and 17,000 merchant wallets.

According to him, the digital currency will enhance financial inclusion, support poverty reduction, enable direct welfare disbursement to citizens, support a resilient payments ecosystem and improve availability and usability of central bank money.

“The eNaira will also facilitate diaspora remittances, reduce the cost of processing cash, and also reduce cost and improve efficiency of cross-border payment,” he said.

The apex bank governor, however, said that the eNaira was the same Naira with far more possibilities.

“The eNaira will make a significant positive difference to Nigeria and Nigerians. It was also developed to provide Nigerians with a cheap, safe and trusted means of payment.

“It is unlike the offline payments channels like agent networks, USSD, wearables, cards and near field communication technology.

“The eNaira would give access to financial services to underserved and unbanked segments of the population,” he said.

He said that innovative products and services built on the eNaira would enhance Nigerians’ participation in the digital economy and promote further development of a burgeoning Fintech ecosystem.

“To achieve these set out objectives, the project adopted a phased- approach with the first phase focusing on banked users, while the policy objective of the second phase borders around financial inclusion.

“In addition, the eNaira platform possesses an innovation layer for products and services to be built with the aim of enhancing Nigerians’ participation in the digital economy,” he said.

According to Emefiele, the second phase of the project has begun and is intended to drive financial inclusion by onboarding unbanked and underserved users leveraging offline channels.

He said that the CBN was now ready to accommodate unbanked Nigerians in the eNaira platform

“Greater success is envisioned for the project with phase two expected to deliver more gains with a target of about eight million active users based on estimations using the diffusion of innovation model.

“When we launched the eNaira, we promised to increase the level of financial inclusion in the Country because just like the Naira, the eNaira is expected to be accessible to all Nigerians .

“It will provide more possibilities to bring in the unbanked into the digital economy.

” I am pleased to inform you that by next week, Nigerians, both banked and unbanked, will be able to open an eNaira wallet and conduct transactions by simply dialling *997 from their phones,” he said.

According to Mr kingsley Obiora, CBN’s Deputy Governor, Economic Policy, the use of physical cash is gradually getting out of fashion across the globe due to the growth of digital currencies.

“In south Korea, 77 per cent no longer use cash to do payment, while in the Philippines it is 30 per cent.

“In Nigeria, we are also seeing the same decline in the use of cash, the minting of currencies in the CBN has been reducing in the last couple of years.

“So alongside this reduction in the use of cash has also been an explosion in e-business and we have seen the value of e-business grow from 393 billion dollars in 2014 to about 2.4 trillion dollars now.

“If you look at this movement, you will realise that the central banks in the world are responding to yearnings of citizens.

“That is why 96 per cent of central banks in the world are either working on digital currencies or they have done so already,” he said.

Daniel Awe, the Group head, AFF, said that the CBN had transformed from traditional regulator to a smart regulator.

Awe said that the Hackathon was a platform that brings entrepreneurs, coders and product managers together to solve problems and build new business model.

“All over the world, there has been disagreement between innovators and regulators.

“This is because regulators usually look at impact on financial stability, impact of those innovators on consumers as well as the risk, while the innovators look at the opportunity in their ideas.

“However, this CBN is different as it has over the years partnered with innovators that will create jobs and bring value,” he said.

FCT Authority Warns Residents of Imminent Flood

The Federal Capital Territory Emergency Management Agency (FEMA) has alerted residents of the FCT of an imminent flood in Abuja.

FEMA asked emergency workers to be ready to save lives and property in the nation’s capital.

Director-General Abbas Idriss issued a statement on Thursday through the Head of Public Affairs Nkechi Isa.

The Nigerian Meteorological Agency (NiMET) High Impact-Based Forecast predicts heavy rainfall which would cause imminent flood in the FCT on Thursday and Friday.

The forecast said there would be flash floods on roads and low lying settlements, disruption of traffic and reduction of visibility.

Also expected are strong winds accompanying the rains may likely damage mud houses or weak structures.

Idriss appealed to the people residing in such structures to relocate to safer places.

He advised restraint through disconnection of electrical appliances, avoidance of parking under trees and driving through waters.

The agency urged members of the public to dial the 112 emergency toll free number in the event of an emergency

China Suffers Severe Drought After Massive Heatwave Strikes Country

Severe drought has hit China exacerbated by a record heatwave has spread across half of China and reached the normally frigid Tibetan Plateau, according to official data released ahead of more searing temperatures on Thursday.

The world’s second-largest economy has experienced over 70 days of heatwaves, flash floods and droughts — phenomena that scientists say are becoming more frequent and intense due to climate change.

Southern China has recorded its longest continuous period of high temperatures since records began more than 60 years ago, the agriculture ministry said this week.

Experts have said the intensity, scope and duration of the heatwave could make it one of the worst recorded in global history.

A chart from the National Climate Centre showed Wednesday that swathes of southern China — including the Tibetan Plateauwere experiencing “severe” to “extraordinary” drought conditions.

The worst-affected area the Yangtze river basin, stretching from coastal Shanghai to Sichuan province in China’s southwest is home to over 370 million people and contains several manufacturing hubs including the megacity of Chongqing.

The China Meteorological Administration predicted continued high temperatures of up to 40 degrees Celsius (104 degrees Fahrenheit) in Chongqing and the provinces of Sichuan and Zhejiang Thursday.

But some regions gained relief from the heatwave. Parts of southwestern Sichuan were battered by heavy rains overnight, causing the evacuation of almost 30,000 people, state broadcaster CCTV reported.

And in the southeast, Typhoon Ma-on made landfall in coastal Guangdong province and Hong Kong Thursday morning.

“High temperatures have basically been alleviated in the regions of south China, Jiangxi and Anhui,” the meteorological administration said.

“But high temperatures will continue for the next three days in regions including the Sichuan basin and provinces surrounding Shanghai.”

SEVERE THREAT

China’s State Council on Wednesday announced a 10 billion yuan ($1.45 billion) subsidy to support rice farmers experiencing drought conditions, which authorities have warned pose a “severe threat” to this year’s autumn harvest.

China produces more than 95 percent of the rice, wheat and maize it consumes, but a reduced harvest could mean increased demand for imports in the world’s most populous country — putting further pressure on global supplies already strained by the conflict in Ukraine.

Wednesday’s CCTV evening news broadcast showed trucks supplying villagers who lacked drinking and agricultural water in rural Sichuan and Chongqing.

These regions have also been battling wildfires since last week, exacerbated by high temperatures and water scarcity.

Livestock owners have fared badly, with Chongqing authorities pledging emergency measures to protect pig farms and a Sichuan farmer’s tearful plea going viral after she said all her chickens had died due to the heatwave and power cuts.

Some Chongqing residents complained on social media about queueing for hours in sweltering heat for compulsory mass testing required in the wake of a Covid outbreak.

In parts of Sichuan and Chongqing, locals seeking cooler temperatures have taken to sleeping in car parks and subway stations due to daily power cuts.

Temperatures as high as 45 degrees Celsius (113 Fahrenheit) have led multiple Chinese provinces to impose industrial power cuts, as cities struggle to cope with a surge in demand for electricity.

Record low water levels on the Yangtze River have also put pressure on the region’s hydropower generators, with the National Energy Administration pledging Wednesday to make up the shortfall by ramping up coal production.

Recent heat broke records in Sichuan, where one county recorded a temperature of 44 degrees Celsius (111 Fahrenheit) Wednesday.

5G Network: MTN Launches 5G Network Trial In Seven States

MTN Nigeria Communications Plc said it has kicked off an open 5G pilot in the lead-up to its highly anticipated commercial launch in 7 states. The states that will witness the first launch, the company said, include Lagos, Abuja, Port Harcourt, Ibadan, Kano, Owerri, and Maiduguri.

In testing the next-generation network infrastructure, MTN’s customers with certain enabled devices will be allowed to connect with and try out the new service, where coverage is available.

The pioneering feat comes more than eight months after the telecom firm and Mafab Communications Limited won a bidding for the two slots available for the start of the spectrum services in the country.

The advanced technology is expected to extend the reach and capacity of MTN Nigeria’s data network in Nigeria and enable much faster speeds and lower latency, giving customers near-instant access to the things they care about and downloads that take seconds, instead of minutes.

Speaking on the pilot kickoff, Adia Sowho, Chief Marketing Officer, MTN Nigeria, said: “5G Network has the potential to change everything.”

He continued stating that: “Every major technological evolution redefines what is possible – changing the way we live and the way we connect.

“MTN Nigeria has been at the forefront of every leap in telecommunications: from GSM to 2G, 3G, and 4G. 5G has the potential to change everything.

“It will allow us to connect, create, collaborate, and compete in ways we’ve not even begun to imagine.

“We appreciate the unwavering support and leadership of the Minister of Communications and Digital Economy and the Nigerian Communications Commission, NCC, in implementing the National Policy on 5G Network for Nigeria’s Digital Economy, which has driven the implementation of 5G in the country.

United States To Return $23.4 Million Abacha Loot

The Federal Government will receive a fresh $23, 439, 724 from the United States being money looted by the late former military Head of State, General Sani Abacha.

FG on Tuesday, signed a fresh agreement with the Government of the United States of America, USA, for the repatriation of the looted money.

According to LEADINGREPORTERS, while the Attorney-General of the Federation and Minister of Justice, Mr. Abubakar Malami, SAN, represented FG in the ceremonial signing of the asset return agreement held at the Federal Ministry of Justice Headquarters in Abuja, the US government, was represented by its Ambassador to Nigeria, Mary Beth Leonard.

The AGF, Malami, SAN, said decision to return the stolen loot which he tagged as Abacha-5, was a product of series of negotiations and meetings between Nigeria, the US Department of Justice and the UK National Crime Agency, NCA.

“It is worthy to note that in line with the terms of this Agreement, Mr. President had already approved the funds to be utilized for the ongoing Presidential Development Infrastructural Funds, PIDF, projects namely; Abuja-Kano Road, Lagos-Ibadan Express Way and the Second Niger Bridge under the supervision of Nigerian Sovereign Investment Authority, NSIA

“The President’s mandate to my office is to ensure that all international recoveries are transparently invested and monitored by civil society organization to compete these three projects within the agreed timeline”, Malami stated.
