Supreme Court Dismisses Suit Challenging Establishment Of EFCC Act

Supreme Court dismisses suit instituted by some state Attorneys General challenging the establishment of the Economic and Financial Crimes Commission (EFCC) Act.

The suit, which was initially instituted by attorneys general of 16 states, sought the scrapping of the anti-graft agency. While some states withdrew from the suit, some others asked to be joined as co-plaintiffs.

The states that initiated the suit include Ondo, Edo, Oyo, Ogun, Nassarawa, Kebbi, Katsina, Sokoto, Jigawa, Enugu, Benue, Anambra, Plateau, Cross-River and Niger.

However, at the resumed hearing on October 22, Imo, Bauchi, and Osun states joined the suit as co-plaintiffs while Anambra, Ebonyi, and Adamawa states announced their decisions to withdraw their suits.

The trio’s suits were struck out, accordingly, by the court.

Supreme Court judgement: ‘Fight has just begun’ – Oby Ezekwesili

Oby Ezekwesili, a former Minister of Education, has declared that the fight has just begun following the Supreme Court judgement that upheld President Bola Tinubu’s election in the February 25 presidential election.

Leading reporters report that the judgement followed appeals filed against Tinubu’s election by Atiku Abubakar of the Peoples Democratic Party, PDP, and Peter Obi of the Labour Party, LP.

Atiku and Obi approached the apex court to appeal the ruling of the Presidential Election Petition Tribunal which dismissed their petitions against Tinubu.

The fight for a Good Society has only now started and we know that nothing can defeat a People who have had enough of the invasive Cancer of Corruption and Criminality,” Oby Ezekwesili wrote on X.

“Read the story of the 70s Hong Kong to learn that in the quest for a Good Society, ‘it is never over until a people say it is over’.”

BREAKING: Gbajabiamila, Ribadu, Others Arrive as Supreme Court Hears Appeals against Tinubu

Several high-profile dignitaries have arrived at the Supreme Court in anticipation of the day’s proceedings as the court is set to hear the appeals of the presidential candidates of the Peoples Democratic Party (PDP), Atiku Abubakar, the Labour Party (LP), Peter Obi, and the Allied Peoples Movement (APM), seeking to nullify the victory of President Bola Tinubu of the All Progressives Congress (APC) in the February 25, 2023 presidential election.

Leading reporters gathered that those present include the Chief of Staff to the President, Femi Gbajabiamila; the National Chairman of the APC, Abdullahi Ganduje; the National Security Adviser of Nigeria, Nuhu Ribadu; and the acting National Chairman of the PDP, Umar Damagum.

The seven-member panel of the apex court is led by Justice John Okoro.

Other members of the panel are Justices Uwani Abba-Aji, Mohammed Lawal Garba, Adamu Jauro, Ibrahim Saulawa, Tijani Abubakar and Emmanuel Agim.

BREAKING: Supreme Court Building in Abuja Gutted by Fire

The Supreme Court building in Abuja is currently on fire.

LEADING REPORTERS learnt that the cause of the fire is still unknown as of the time of this report.

However, some persons were seen around the apex court complex evacuating documents and property from Justice chambers.

This newspaper learnt that firefighters are currently battling the blaze, and no casualties have been reported as of press time.

APC National Convention: Ameachi Doles Out $10m To Support Sen. Abdullahi Adamu Candidacy

The Honourable Minister of Transport, Rt. Hon. Rotimi Amaechi, is allegedly on a spending spree to support his preferred candidate, Senator Abdullahi Adamu who is running for the office of the Chairman of the ruling All Progressive Congress.  Discreet information availed LeadingReporters revealed that the Minister is said to have so far availed a whopping sum of N600m as a ‘welcome package’ for All Progressive Congress delegates who are currently in Abuja for the ruling party’s national convention holding in Eagle Square. 

A discreet source who is in the know told LeadingReporters that the cash-spree is to ensure the emergence of Senator Abdullahi Adamu as the National Chairman of the ruling All Progressive Congress party.

Amaechi is believed to be one of the presidential aspirants of the party who is believed to be seriously working from behind the scenes towards actualizing his presidential ambition.  

The source said that Amaechi is doing everything possible to ensure the emergence of the former Governor of Nasarawa State,  Senator Adamu Abdullahi, who by Amaechi’s calculation would aid him to seamlessly pick the party’s presidential ticket.

However, Amaechi loyalists and close associates still believe that erstwhile Governor of Rivers State has many hurdles to cross.  One of such huddles is said to be a criminal case leveled against him by Nyesom Wike-led Rivers State Government.  Wike has previously constituted a commission of inquiry to probe into the era of his predecessor.  The commission, after their investigation alleged that Rotimi Amaechi embezzled N96billion and criminally sold Rivers State property unilaterally when he served as Governor.  The Transport Minister was unable to stop the probe, using the instrumentality of the court.  The case is currently in Supreme Court of Nigeria. The apex court has fixed May 2 for hearing on the matter.

Another factor feared may clog the wheel of Amaechi’s presidential ambition borders on certain secret information linked to Amaechi, including a recorded audio tape where Amaechi was heard tongue-lashing President Muhammadu Buhari, and calling him unprintable names.  He was said to have shared very secret information regarding the President’s penchant for foreign loans. Although it was learned that Amaechi was able to suppress the spread of the tape, using a popular Auchi based clergy, there are indication that the information is already in the hands those who may use it as a political weapon come 2023.

Why Supreme Court Nullified Buhari’s Executive Order 10

The Supreme Court on Friday revealed that the reason it nullified Executive Order 10 by President Muhammadu Buhari is because the country is “run on the basis of rule of law.” Recall that Buhari had in May 2020, signed the order into law. 

According to the Apex court, the Nigerian leader overstepped his powers by promulgating such a rule. The order grants financial autonomy to the legislature and the judiciary in the 36 states of the country. 

The order also mandates the accountant-general of the federation to deduct from source amount due to state legislatures and judiciaries from the monthly allocation to each state for states that refuse to grant such autonomy. 

That order has now been voided by the Supreme Court which ruled Friday in a suit by the 36 states against the federal government. In its ruling, the seven-member panel of Supreme Court judges, in a split-decision of six justices to one, held that the Constitution provides a “clear delineation between the state and federal government.

”“The president has overstepped the limits of his constitutional powers,” the court ruled about the president promulgating Executive Order 10.

“The country is run on the basis of rule of law,” the judges said. 

The majority decision adopted the expert opinion of Musibau Adetunbi and Mahmud Magaji, two of the Senior Advocates of Nigeria, invited by the Supreme Court to advise it on the matter. More details later…
