BREAKING: Former CBN Governor Godwin Emefiele granted bail

by Nelson Ugwuagbo November 8, 2023
written by Nelson Ugwuagbo

The court, in a ruling that was delivered by Justice Olukayode Adeniyi, ordered that he should be released to his lawyers.

“There must be an end to detention without trial” the judge held, stressing that it was the refusal of the Economic and Financial and Crimes Commission, EFCC, to comply with the order the court made on November 2, that led to the ruling.

Besides, the court held that it could not allow Emefiele to remain in custody owing to claim of the Federal Government that he would on November 15, be arraigned on a fresh charge.

It held that the claim was speculative as there was nothing to establish that the planned arraignment would hold as scheduled.

More so, the court noted that a purported remand order that FG’s lawyer tendered before it, which was signed by an Abuja Chief Magistrate, bore conflicting dates.

“A very crucial fact that this court cannot overlook is the Applicant’s claim that he has been incarcerated for a period of upward of 151 days without trial,” Justice Adeniyi added.

He held that section 298(2) of the Administration of Criminal Justice Act, ACJA, 2015, empowered the court to make necessary orders, even when there is a remand order against an Applicant.

Consequently, the court directed that Emefiele should be released to a team of three Senior Advocates of Nigeria, SANs, that represented him in the matter.

EFCC fails to produce Emefiele, as judge restates release order

It held that the lawyers should produce him in court on November 15 for his planned arraignment or at any other date that he is required to appear in court.

Justice Adeniyi directed Emefiele to surrender all his international documents to the most senior Registrar of the court, pending his arraignment.

It subsequently adjourned further proceedings in the matter till November 17.

The ruling followed a fundamental right enforcement suit that the erstwhile CBN boss, who has been in detention for about five months, filed through his team of lawyers led by Mr. Matthew Burkaa, SAN.

Cited as Respondents in the suit marked: FCT/HC/CV/040/2023, are; the Federal Republic of Nigeria, the Attorney-General of the Federation, AGF, Chairman of the Economic and Financial Crimes Commission, EFCC, as well as the anti-graft agency itself.

It will be recalled that President Bola Tinubu had on June 9, suspended Emefiele from office as the head of the apex bank.

He was later arrested at his Lagos residence by the Department of State Services, DSS.

Emefiele had since then, faced a two-count charge of illegal possession of a firearm and ammunition before the Federal High Court in Lagos, as well as a 20-count corruption charge that the Federal Government entered against him and two others before an Abuja High Court sitting at Maitama.

However, proceedings in both cases were put on hold, following the decision of the Defendants to explore a plea bargain deal with FG.

The former CBN boss was subsequently transferred to the EFCC detention facility, by the DSS.

FG had in opposition to Emefiele’s request for bail, notified the court that he would on November 15, be arraigned on a fresh charge.

It will be recalled that Justice Adeniyi had on November 2, ordered the anti-graft agency to either release the embattled former CBN Governor, unconditionally, or produce him in court to be granted bail.

In compliance to the directive, the EFCC produced him on court for the hearing of his bail application.

“NITEL Ex-Workers Demand Justice: 17 Years On, Unpaid Severance Package Claims Lives”

by Nelson Ugwuagbo November 7, 2023
written by Nelson Ugwuagbo

Former employees of the Nigerian Telecommunications Limited (NITEL) and its subsidiary, the Nigerian Mobile Telecommunication (M-tel), have taken to the streets of Abuja to protest the non-payment of their severance package 17 years post-privatisation of NITEL.

NITEL, the state-owned telecommunications company, was privatised in 2006, leading to the disengagement of many employees.

The company and its mobile arm M-Tel were eventually sold through “guided liquidation” because of its huge liabilities.

In 2015, the government finalized a transaction that saw NITEL and M-tel’s assets sold to the National Commission (NATCOM). The deal was valued at $252.521 million.

But speaking during the protest, one of the ex-workers who didn’t provide his name said the Federal Government had previously approved and allocated funds for the unpaid severance packages. He questioned the delay in disbursing the funds.

The protesting workers expressed their frustration and disappointment over the situation and demanded an urgent response from the authorities and immediate disbursement of their long-overdue severance packages.

One of the protesters said, “We need this money. I’m from Nitel, M-tel staff, disengaged over the years and they don’t want to pay us.

“The money has been assigned and approved by the Federal Government. This is seventeen good years. Many have died without being paid. What are you keeping the money for?”

Lagos Account Officer Jailed For Stealing Company’s N1 Million

by Nelson Ugwuagbo November 7, 2023
written by Nelson Ugwuagbo

An Ogudu Magistrate’s Court in Lagos on Tuesday sentenced a 31-year-old account officer, Shitu Olawale to one year imprisonment for stealing N1 million belonging to his employer, BSG Multi-Stream Ltd.

Olawale, an account officer at BSG Multi-Stream Ltd, a company that gives out loans, was charged with two counts of forgery and theft

The Magistrate, Mrs O.A Daodu who sentenced Olawale after he was found guilty, did not give him any option of a fine

Earlier, the prosecutor, Insp Bassey Sunday told the court that the convict committed the offence on May 11 at BSG Multi-Stream Ltd, located at Ikorodu Road, Ketu Bus Stop.

Sunday said that Olawale forged two GTB debit transaction receipts with reference numbers 09026723024911011729006307381 and 090267230511054673200630738 showing two different debit alerts of N50,000 respectively.

He said the convict stole monies the company gave him in different sums amounting to N1 million to disburse to different customers.

”The convict forged and stole on different occassions, leading the company he is employed into, to believe that he had actually given out the approved loans to its customers”, the prosecution said.

The offence, the police said, contravenes the provisions of Section 287(7) and 365 of the Criminal Law of Lagos State, 2015

15 killed as flooding hits Kenya

by Nelson Ugwuagbo November 6, 2023
written by Nelson Ugwuagbo

At least 15 people have died in Kenya as floods swept away scores of houses and devastated farmland following torrential rains, the Red Cross said on Monday.

Heavy rainfall has pounded the country, particularly the bone-dry north, in recent days, and sent water gushing into homes and submerging roads, with similar scenes playing out across other parts of East Africa.

“As of yesterday, 15,264 households have been affected, with 15 casualties reported,” the Kenya Red Cross said on X, formerly Twitter.

More than 1,000 livestock have died while at least 240 acres (97 hectares) of agricultural farmland have been destroyed, it added.

The UN’s humanitarian agency, OCHA, said last month that eastern Africa would likely encounter heavier than normal rains over the October-December period because of the El Nino phenomenon.

Kenya’s Meteorological Department also warned last week that the heavy rains were “likely to be accompanied by gusty winds”.

“The strong winds may blow off roofs, uproot trees and cause structural damages,” it said in an advisory.

Images broadcast on local media have shown flood waters inundating entire villages and sending residents fleeing for higher ground.

Dramatic footage showed a civilian chopper rescuing people from a lorry marooned in Samburu county, some 300 kilometres (190 miles) north of the capital Nairobi.

El Nino is a naturally occurring weather pattern associated with increased heat worldwide, as well as drought in some parts of the world and heavy rains elsewhere.

Since the start of the current rainy season, more than 20 people have died and over 12,000 others have been forced out of their homes in Ethiopia’s Somali region due to flash flooding, the regional government said at the weekend.

At least 14 people have also been killed in Somalia, OCHA said in a situation report released on Saturday.

“At least 47,100 people have relocated to higher grounds to avoid the risk of flooding,” the agency said, adding that the downpours had cut off access to markets and farmland in some areas.

The Horn of Africa is one of the regions most vulnerable to climate change, and extreme weather events are occurring with increased frequency and intensity.

Since late 2020, Somalia as well as parts of Ethiopia and Kenya have been suffering the region’s worst drought in 40 years.

At the end of 2019, at least 265 people died and tens of thousands were displaced during two months of relentless rainfall in several countries in East Africa.

The extreme weather affected close to two million people and washed away tens of thousands of livestock in Burundi, Djibouti, Ethiopia, Kenya, Somalia, South Sudan, Tanzania and Uganda.
