In support of their application, the lawyers cited Sections 36(1) and 130(2) of the 1999 Constitution of Nigeria, as amended.

Section 36(1) guarantees the right to a fair hearing in the determination of civil rights and obligations, while Section 130(2) identifies the President as Head of State, Chief Executive of the Federation and Commander-in-Chief of the Armed Forces.

The court is now being asked to determine whether the circumstances presented by the applicants justify an order requiring Dagazau to step aside and directing the President to suspend him while the House of Representatives investigation continues.

The outcome of the application will determine whether the court grants the requested interim reliefs. Until the allegations are established through the appropriate legal process, they remain allegations against the NNPCL executive.
